Terms of Service

1. Agreement
These Terms of Service ("Terms") govern your use of Mailbara, an email infrastructure platform operated by Bogo Labs (bogosac S.A.C.), a company registered in Peru ("we", "us", "our").
By creating an account or using Mailbara, you agree to these Terms. If you do not agree, do not use the service.
2. Description of Service
Mailbara provides email campaign management, contact management, template editing, analytics, and programmatic email sending through a web dashboard, CLI, API, and MCP server. The service is available in multiple subscription tiers as described on our pricing page.
3. Account Registration
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the service.
4. Subscriptions and Billing
Mailbara offers free and paid subscription plans. Paid subscriptions are billed monthly and renew automatically until cancelled. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
All payments are processed by Paddle.com Market Limited ("Paddle"), who acts as the Merchant of Record for all transactions. Paddle handles invoicing, sales tax, VAT, and payment processing on our behalf. By purchasing a subscription, you also agree to Paddle's Terms of Use and Privacy Policy.
5. Refund Policy
We offer a 30-day full refund policy on all paid subscriptions. If you are not satisfied with Mailbara for any reason, you may request a full refund within 30 days of your purchase. No questions asked. Refunds are processed by Paddle and typically appear within 5-10 business days. See our Refund Policy for details.
6. Acceptable Use
You agree not to use Mailbara to:
- Send unsolicited or spam email
- Send content that is illegal, harmful, threatening, abusive, or harassing
- Violate any applicable anti-spam laws (CAN-SPAM, GDPR, CASL, etc.)
- Send emails to purchased, rented, or scraped contact lists
- Impersonate any person or entity
- Interfere with or disrupt the service or its infrastructure
- Attempt to gain unauthorized access to other accounts or systems
We reserve the right to suspend or terminate accounts that violate these terms.
7. Email Sending Compliance
You are responsible for ensuring that your email campaigns comply with all applicable laws. All marketing emails must include a working unsubscribe mechanism. You must only send to contacts who have given proper consent (opt-in).
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. We are not liable for downtime caused by factors beyond our control.
9. Data and Privacy
Your use of Mailbara is also governed by our Privacy Policy. You retain ownership of your data (contacts, templates, content). We do not sell your data to third parties.
10. Intellectual Property
Mailbara and its original content, features, and functionality are owned by Bogo Labs (bogosac S.A.C.). You retain all rights to the content you create and send through the platform.
11. Limitation of Liability
To the maximum extent permitted by law, Bogo Labs (bogosac S.A.C.) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the service.
12. Termination
You may terminate your account at any time by contacting us or through your account settings. We may terminate or suspend your account if you violate these Terms. Upon termination, your right to use the service ceases immediately. You may request an export of your data within 30 days of termination.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the service. Continued use after changes constitutes acceptance of the new Terms.
14. Governing Law
These Terms are governed by the laws of Peru. Any disputes shall be resolved in the courts of Lima, Peru.
